Totalitarianism: New Immigration Policy

I witnessed a father and daughter deceased in a river dividing America from Mexico. Although it was hard to digest I was glad it was shown. The Zero Tolerance policy has created controversial issues and many of migrants to live in inhumane treatment in detention centers. According to the constitution all humans have rights and immigrants have rights as well whether illegal or legally.


When the Zero-Tolerance Policy was announced, migrants seeking asylum seeks can come through legal points of entry (Digest, 2018). Some migrants will get in illegally, but still able to seek asylum protection. Under Trump administration illegally entry would cause migrants to be detained and children separated ("Congressional Research Service," 2019). With overcrowding and inhumane treatment of adults and children led the American Civil Liberties Union (ACLU) to file lawsuits against the Trump administration.


The challenges with this policy are:

• all illegal border crosser apprehended between U.S. ports of entry would be criminally prosecuted for illegal entry or illegal reentry

• policy makes no exceptions for asylum seekers and/or family units

• children are processed as unaccompanied alien children

(Digest, 2018)

These are just the surface issue of the Zero-Tolerance policy. Under this policy there has been many officials being questioned by congress and avoiding the problems associated under this policy ("American Civil Liberties Union," 2019). Another issue with migrants being detained, is them not able to be provided Due Process under the constitution. The judicial system is overloaded with court hearing and cases related to immigration and this policy added unnecessary cases brought on by the ACLU ("American Civil Liberties Union ," 2019).

In my opinion coming up with a resolution are complicated because to many people are involved. If congress create a bill, it is rejected. If we want a way to place the judicial system were to be in charge with carrying out the law instead of the president a new policy can work in a positive direction.
